HOLTSVILLE, N.Y., Aug. 5 - Symbol Technologies, Inc. (NYSE: SBL), The Enterprise Mobility Company(TM), today announced that it has settled its lawsuit against Mobile Knowledge Group Services, Inc. and Mobile Knowledge Group, LLC (collectively "MKG") alleging trademark, trade dress, copyright, design patent and related intellectual property claims. The lawsuit, filed on November 5, 2004 in the United States District Court for the Eastern District of New York, alleged that MKG was misusing Symbol's intellectual property rights in connection with the sale of after market spare parts for use with genuine Symbol products.

Under the terms of the settlement agreement, MKG agreed to stop selling certain products in which Symbol claimed trade dress and design patent rights, and to pay Symbol an undisclosed sum of money.
"We are pleased with the settlement reached today which protects Symbol's reputation and prevents confusion in the industry caused by the misuse of Symbol's trademarks, trade dress, copyright and design patents," said Peter Lieb, Symbol senior vice president and general counsel. "Symbol has made considerable investments to develop high-quality products and continues to strengthen its intellectual property position by obtaining patents that cover industrial designs. We have a responsibility to our shareholders to pursue companies that sell products or provide repair services in violation of our intellectual property rights."
